Will it be the 6 - 4.7 years i.e 1 year 5 months or a 3 year extension since i have a 140 approved? Link to comment

Attorney_10 Posted September 5, 2012 Report Share Posted September 5, 2012 Generally, if an individual on H1b status has an approved I-140 petition, s/he may request an H1B extension for up to 3 years. This will include the time remaining on his/her 6 years of H1B time plus additional time (up to a max of 3 years) based on the I-140 approval. As with any H1B petiton, the petitioner must demonstrate that sufficient specialty occupation work will persist for the entire validity period requested. Link to comment
