l1btol1a Posted September 4, 2012 Report Share Posted September 4, 2012 Hi Seniors, Please suggest me on my L-1A RFE. I came to US on L-1B and this is going to expire on October 2012. My Employer filed for L-1A (Premium Proc) and got RFE regarding L-1B amendment. My employer explained my Functional Manager duties in employer support letter which I am already performing but we never filed an amendment for L-1B for my Functional Manager duties. Now, USCIS is asking that If I want to qualify for L-1A, I need to perform the Managerial duties atleast 6 months in US. And the USCIS saying, If I am already performing the Managerial duties then provide the L-1B Amendment as a proof of my duties. FYI, my employer filed my change of status to L-1A before 2 months of expiring my L-1B. Is this difficult to convince the Officer or is something easy to explain? Please suggest. Thanks, Shurap1 Actually, We haven't filed for L-1B amendment due to some valid reasons. Same thing we explained when we replied to RFE and it got approved. Link to comment
