L1 Expired H1 Start date

Hello,

I will be completing 5 years on L1 B next year (May-2012) and my i-94 is valid till 2014. My employer is ready to file for H1B in 2013 cap. My question is if i go for premium processing and gets my H1B approval before May 2012 can i work on H1 B after approval or I have to wait till 1 Oct 2013?

The start date will be indicated on the approval; assuming the petition is filed for the next fiscal year, it would be no earlier October 1.
