samtron
Hi All, Please help me to understand the h1b amendent process in my case. My visa expiry date is oct 2014 and i have not travelled till now and in India only.(stamping date nov 2011. Client ABC location XYZ) There is an opportunity with new client (OOO) and new location(LMN). In this case 1.Do i need to go for H1b amendement? 2.Do i need to go for stamping again in india? 3.Fees? Thanks in Advance, Sam Link to comment
SameerH1Bworker
1.Do i need to go for H1b amendement? - As long as client location changes, one needs to file H1B amendment. 2.Do i need to go for stamping again in india? - If you've valid visa stamp then you do not need to go for re-stamping. While coming back to US, show your latest I-797A to get I-94 with that dates. 3.Fees? - Company pays this fees. Link to comment

Shruti1983
I had a talk with an attorney and I found that every time when there is a change of more than 30 miles in geographic location of your work you should have H1 Amendment. However I dont think any body who stays in USA and relocate within usa for more than 30 Miles ever go for H1 Amendment, he/she just gets a new LCA for new location. Since you are already in India, you must go for H1 Ammendment. But better get a final advise from an Immigration attorney regarding this. Regards, Link to comment
