H1B transfer related Question

Hi ,

I have H1B valid till 10 May2013 for an Indian IT company, my employer would be filling H1B extension for me in dec 12 or jan 13, I am planning for a 2 weeks trip to India during Apr.

I have few Q's below please Advise..

1) Is it advisable to travel during yours H1B extension is in process ? basically is it I94 extension or VISAI797B itself. so if someone travels outside while extension is in process will they consider the I94 as it wud not be valid in this case since you have exit.?

2) If I plan to travel in first 2 weeks of APR , is it ok to re-enter as I wud be having VISA for another 2/3 weeks only so will there be any issue ?. as I have heard that you need atleast 2 months VISA for urs travel.

3) In case my employer files a premium processing in Jan and I get my approval in March say then can I travel in Apr and can reeneter showing my current VISA valid till May 2013 and the approved Extension letter.

If you leave USA while H1b extension, your H1b may approve but extension will fail. Leave the USA after getting approval or stay out of USA till the approval get the new I797, present it at POE and get new extended I94 at POE.
