gspark Posted August 3, 2012 Report Share Posted August 3, 2012 Hey there, so I am taking up a H1 status job for the next 3 years after which i plan to go to grad school in the US which would place me in F1. If I get a second H1 based job after the F1, how is this scenario different from 6 years straight on H1 status in terms of applying for a GC? Link to comment
Attorney_22 Posted August 3, 2012 Report Share Posted August 3, 2012 Generally, anytime in the U.S. not in H1B or L1 status will not be counted against the six year H1B limitation. Additionally, F1 is strictly a non-immigrant intent status and therefore if you have started a green card petition it may interfere with this status. Thus it is advisable to discuss this in more detail with a qualified U.S. immigration attorney directly.
