Re-entry permit application

Recommended Posts

We recently got our PR through EB1 (employment based) category and want to try a job opportunity in India for a year or so. To maintain the PR status we want to apply for a re-entry permit, the questions are:

1. Is this ok, are there are any catches we are missing?

2. Can we apply for re-entry permit ourselves, do we need an attorney/law-firm? The application seems quite simple and straight-forward.

3. What are the possibilities of rejection or approval being denied?

4. What is the processing time for biometric call & final-approval?

5. If we abandon our current PR would it be a problem for immigration to US in future?

Thanks, we greatly appreciate your help.

Generally, an individual can apply for a re-entry permit without a lawyer and as long as your legal permanent residence is valid and the information on the I-131 is accurate the re-entry permit will most likely be approved. It is important to remember that even with a re-entry permit you must continue the intention to return to the U.S. as legal permanent residents and continue to act accordingly by maintaining ties to the U.S. Biometrics will be schedule approximately one to two months after the application is received and the permit will be issued in approximately one to two months after that. To discuss any other issues it is advisable to speak to a qualified U.S. immigration attorney. The Murthy Law Firm has a very well-regarded Green Card Department with extensive experience who would be able to provide you with excellent assistance. Please feel free to call our office to schedule a consultation with one of our attorneys.
