H1 B extension for 9 th year

Hello,

I'm on 8th year in H1 B Visa.

Applied GC with Employer A in EB3 during 5th year and my perm went to Audit. Got extension for 7 th year , in the 7 th year perm got denied. Employer A applied for re appeal and applied for 8th year extension and got the H1 Extension for 8th year.

I have transferred the 8 th year H1 extension to Employer B . Employer B started the new EB2 Perm and it is still pending and my Visa Expires in Oct 2012.

Incase if my perm didnt get approved before my visa expiry ,Can Employer B still apply for i140 while Im in India and apply extension for 9th year?
