My current client is willing to hire me and sponser my GC. Is it possible for me to transfer my H1B even though I don't have Labor and I 140 approved. Thank you Link to comment
Attorney_22 Posted July 26, 2012 Report Share Posted July 26, 2012 Generally, as long as you have a valid Labor Certification that was filed more than one year ago you may utilize it for a post six-year H1B extension, however there is some risk in doing so. Therefore it is advisable to speak to a qualified U.S. immigration attorney directly prior to proceeding.
