My Employer filed Labor on July 25th 2011 My Employer have received 2 REFs - One on Sep 29th 2011 regarding ETA 9089 form. - Second on Feb 28th 2012 regarding Employer's Recruitment process Both of RFEs have been responded with 10 days my employer received those. My H1B has been expired on June 4th 2012. I have exhausted all 6 years on my H1B. Based on my employer's suggestion on June 1st I left for India and got my H4 VISA stamping using my spouse's active H1B VISA. My employer suggested that this way they would be able to file for H1B extension in case My PERM still remained pending for 365 days (i.e. July 25th 2012). Now I am back in US. As of today my PERM is pending for 365 days. Based on information above when can my employer file for my H1 extension ? Link to comment
