My H1B petition is denied stating that the funds are insufficient . What are my options? Is there a way to request USICS for reconsidering the petition. I have submitted all the required documents client letter, pay checks etc. Please reply. Link to comment
JoeF Posted July 19, 2012 Report Share Posted July 19, 2012 If the employer's check bounced it looks as if the employer doesn't have the money to pay your salary to begin with. Find a better employer, one who actually earns enough money to hire you and pay your salary. Link to comment

'Insufficient funds' is employer's issue, though you have all the documents your petition will be rejected again bcos the problem is in your employer. Find an new employer, suggest you to go for FTE if you have enough time. And I think you come under cap-gap if you file next year, but make sure whether you are eligible for cap-gap or not.
