Bharath88
I have a few questions related to H1B process. I have an option to work remotely and deliver the work to the client. I am on a EVC model. My Employer and the client do not have any issues with me working remotely as long as I deliver the work. I want to know a) If I can work from India for couple of months and come to US once in 2 or 3 months? b) If my employer can run my payroll n USA as I am delivering the work? c) Are there any limitations on the number of days one can reside outside USA on H1B? d) Is there any issue of violation LCA rules here when the LCA has been filed for my home address as well as my client's address? e) Would there be any issues with H1B site visit? Your expert advise would be of great help. Link to comment
JoeF
By definition, you only have a status while you are in the US. You can of course work remotely from outside the US, but there may be tax complications. Check with a good CPA knowledgeable about international tax issues, in particular with your home country. Bharath88
Thank you Joef. The tax issues can be handled by consulting a good CPA. My concerns are with the five points mentioned above, which are the payroll, LCA compilance, H1b site visit, number of days outside US and H1B compliance. Link to comment
JoeF
As I said, you are not on H1 if you are outside the country. So, there is nothing to care about any H1-related stuff like H1 compliance, site visits, etc. Link to comment
