varunta Posted July 16, 2012 Report Share Posted July 16, 2012 I am currently on my fourth year on a H-1B visa. I am planning do an MBA next year. Will the H-1B renew for another six years after I complete my MBA? Is there a difference if the MBA is done part time vs full time? Link to comment

Attorney_22 Posted July 16, 2012 Report Share Posted July 16, 2012 Generally, there are two provisions for H1B extensions beyond the normal six year limitation: 1) if an I-140 petition filed on a beneficiary’s behalf in the first three employment categories is approved and that beneficiary must be eligible to adjust status but for the per country limitations; or 2) if 365 days have lapsed since the filing of a labor certification (unexpired and unrevoked) or an immigrant visa petition on the beneficiary’s behalf. There are no provisions for H1B extensions based solely on obtaining a U.S. Master’s degree.
