Jack.mad
Hi Is that all H1 Applications should be closed/processed by USICS before 1 Oct ? Is there any law or something related to this? Cheers RJ Link to comment
Jack.mad
I meant: Will be processed by USICS before 1 Oct? Link to comment
JoeF
No, there is no such law. Link to comment
nineballs
No, There is no such law. Even with the start date as oct 1st on the H1b application, USCIS can start the process/approve the application anytime after October 1st. USCIS takes its own time unless you upgrade to premium processing. www.pickdaycare.com Link to comment
BigJoe5
INA 214 ADMISSION OF NONIMMIGRANTS ************ (g) (1) The total number of aliens who may be issued visas or otherwise provided nonimmigrant status during any fiscal year (beginning with fiscal year 1992)- (A) under section 101(a)(15)(H)(i)(b) , may not exceed-- (i) 65,000 in each fiscal year before fiscal year 1999; (ii) 115,000 in fiscal year 1999; (iii) 115,000 in fiscal year 2000; (iv) 195,000 in fiscal year 2001; (v) 195,000 in fiscal year 2002; (vi) 195,000 in fiscal year 2003 and (vii) 65,000 in each succeeding fiscal year; or *********** FN 2 Paragraph (g)(1)(A) amended by section 411(a) , Pub. L. 105-277, ACWIA. Section 102(a)(1) and (2) of Public Law 106-313, dated October 17, 2000, redesignated clause (v) as (vii), removed clause (iv) and added clauses (iv) through (vi). Section 103 of Public Law 106-313 added paragraphs (g)(5) through (g)(7). Section 108 of Public Law 106-313 revised section 214(g)(3). *********** The problem you worry about does not exist. The problem is that more people apply than there are visas allowed by law. Link to comment
