When I requested my Manager as i need some more to find a new job they told me to take a week of unpaid vacation for 2 weeks in a month. let's say my pay roll period is from 1 - 15 and 16 - 30. They want me to take a week off in the first pay roll period and another week in 16-30 pay period. So that they can pay me the same as they want to. 1) Does this create any issues 2) I need to find a new job and transfer my H1B to them. All of my previous pay stubs will be for $3600 and the last 2 pay stubs will be for $1800. Does this create any issues for H1B visa transfer. Dont reply that they have to pay minimum of LCA. Definitely it is more than LCA. Your responses will be very helpful. Link to comment

JoeF Posted July 14, 2012 Report Share Posted July 14, 2012 On H1, you can not just take an unpaid vacation and stay in the US. You should file a COS to some other status, e.g., B2, if you need more time. If you decide to return to your home country, the company has to pay for your ticket, by law (not for dependents, though.)
