JoeF Posted July 13, 2012 Report Share Posted July 13, 2012 There are 3 steps for an employment-based GC. The last step requires that the so-called priority date as listed on the monthly Visa Bulletin (google it) is current. The PD is currently not available for EB2-China and India. Link to comment
BigJoe5 Posted July 13, 2012 Report Share Posted July 13, 2012 EB2 is a "preference" category visa and the "filing date" of the APPROVED underlying visa petition (an I-140) transforms into a "priority date" for the purposes of applying for an immigrant visa or filing for adjustment of status. The priority date is listed in the monthly Visa Bulletin when visas are available in a preference category. Read the Visa Bulletin. There is a certain amount of guesswork (best estimates, monitoring filing volumes, etc...) in the Monthly Visa Bulletin which is published by the State Department. When there are not enough visas to go around, they list "U" for unavailable. EB2 is currently unavailable for those from China and India. This will eventually change.
