H1B prevailing wages before ETA 9035

Hi,

I couldn't find topic with similar problem, so making a new one.

I am working as Marketing Specialist in medical center. My employer has filed the H1B visa and I will receive it (at least I hope to) in October. The ETA 9035 & 9035 E have October 1/2012 in the Period of Intended Employment, but I have been working for the company for 4 months by now. The question is - when does the company have to start paying prevailing wages? Can it stick to the legal minimum until the H1B is being processed.

Generally, the H1B employer is required to begin paying the salary listed in the LCA upon the effective date of the LCA and H1B petition. There are no wage requirements for immigraiton purposes for nonimmigrants working pursuant to F1/OPT, L1, L2, etc. Please schedule a consultation with a qualified immigration attorney to discuss the specific facts of your case and to determine when your employer is required to start paying the LCA wage.
