Details Regarding OPT

I am asking this on behalf of my friend.

He did his UG in India and then came here to do MS. Then after completing his MS (in his first US university) he went to another university to pursue his PhD and did not apply for OPT then.

Now if he is not able to complete his PhD in this new university,

1) Can he apply for OPT using the MS he obtained in his first university ?

2) He is eligible to get another MS degree from his current university in the same department even if he drops out of his PhD program. Will he be able to apply for OPT using this second MS degree ?

Any small help on this will be appreciated.

2 yes .. as per his situation he can apply using 2 nd master degree .
