rahule29
I m looking to transfer my H1 to a new employer but my new employer wants me to resign as soon as they start the H1 transfer.By the time i will get the receipt number i would have served the notice to my old employer. Now in the event that there is rejection in this H1 transfer (normal processing) is it that i need to leave the country or i still get some time to look for new empllyeer? wiweq
" it that i need to leave the country or i still get some time to look for new empllyeer?" => If you leave the current employer and new H1b fails, you would be left OOS, and would need to leave USA. I would suggest you to join the new employer ONLY after complete approval. By H1b law, you CAN work on receipt but not HAVE to. Pay PP fees if needed to escalate the new H1b. Link to comment
