H1 Transfer before Oct 1st

Hi ,

I am currently employed with employer A and my H1B Visa has been approved and will be effective from Oct1st. I will be on Cap Gap for a while before my H1B become effective. I got a job offer from employer B and would like to start job there from Oct 1st. Few questions:

1. Can my approved H1B be transferred from employer A to B or will there be any issues?

2. Will I face any issues when I go to India for getting in stamped early next year?

Yes, definitely you can. I asked same question before few days as I am in same situation. Technically it is a new H1B applicatoin as your current approval is not yet been effective. Read post

My new H1B application has just been approved for process so I can say DEFINITELY you can change job. Only thing is you won't be considered for CAP as CAP is already assigned to you.

2 it depends on lot of other factors changing employer before oct1 is not an issue for stamping ..
