imajumder2012 Posted June 23, 2012 Report Share Posted June 23, 2012 Respected Attorney, I had a L1B Visa which expired on 8th APril 2012, I served the entir 3 years of Visa. My company applied for extension for L1B while i was in US in premium processing, USCIS replied RFE within 15 days, now the evidences asked where so unique that my company decided not to reply to RFE and withdrawn the petition. This made me came back to India before 8th April. My company was planning to file my H1B for 2013 but couldn't because the quota got expired soon. So they are again planning to file my L1B. My Question: > Can I file for a fresh L1B? > Will early history of extension will be having any effect on the fresh file? > If Visa gets approved what will be my maximum tensure of stay 2 yrs or 3 yrs? Attorney_23 Posted June 25, 2012 Report Share Posted June 25, 2012 A person may remain in L1B status for a total of 5 years, after which he/she must leave the U.S. for 1 year in order to return in L1B status. The Consulate may take into consideration the previously withdrawn petition, but this would not generally make a person ineligible for L1 status. Link to comment
