H1B RFE

Hi,

This is *****. Applied H1 on June 1.. Premium Processing..

I applied H1 with everything including client letter but I got an RFE. I do not know why. The RFE wanted a Employer-Employee Relationship and to explain why my position is a Speciality Occupation.

My employer had all explanation about all these when he applied for the VISA. I am like worried as to why USCIS again wanted explanation about these things again.

My employer says he will take care of it but I am a little worried.

Well.. is getting worried taking you anywhere ???

Getting an RFE is no big deal, and it has become a norm lately, like your employer said, reply to the RFE and wait.

Thank you for replying. I an worried because my employer sent out all those documents nee ded when he first applied for the visa. But uscis wants them again. I do not know why. I cannot think of anything that we did not submit for us to get this rfe.

Don't worry. H1b petition is employer's property, they have paid for this, and they know better how to get best from their money.

If you have good academics/ work experience in the same filed of your job, this RFE should not be a big deal. I have seen this happens more with the small companies filing H1b first time. As they don't have H1b history, USCIS wants to make sure if they really need H1b employee.
