Now Comp B filed transfer and got an RFE.If my H1 transfer is rejected then 1) how much days or months can we stay with the rejected RFE in US ? 2)Suppose If we have one month time, and in this one month can we ask Comp B again to file a new petition with the correct documents? Do u see any issues like this? 3) If we file again a new petition , the paystub for the month(RFE period) from B can be usefull and can we submit this paystub? I have the option to go back and start work with old employer A.But I dont want to work again with the same employer. Please help me frens !!! Link to comment

If you are not maintaining other H1b status, you will be counted OOS and have to leave USA. 2)Suppose If we have one month time, and in this one month can we ask Comp B again to file a new petition with the correct documents? Nope, for filing H1b extension you should maintain valid status in US. 3) If we file again a new petition , the paystub for the month(RFE period) from B can be usefull and can we submit this paystub? => Who are 'we' here? Group of people, all have same issue, who are they? Nope, if H1b is not approved you would be accruing out of status days from the date you left emp A. Paystubs of emp B are none of use for H1b petition purposes. Link to comment
