L2 (EAD) to L1

Hi Attorny,

I am on L2 visa and also have EAD.

So my employer in indra sent me to USA (onshore). Now they are planning to get my L1 done.

My question is if they do my L1 while i am in USA

1) Do i have to go to India for stamping

2) is der any chances of rejection ?

Foreign nationals generally can only obtain a visa by applying at a Consulate in their country of origin. However, the visa is only used to request permission to enter the U.S. If a person is already in the U.S. and a change of status petition is filed, the foreign national is not obligated to apply for a visa unless he/she wishes to travel outside the U.S. and then reenter in L1 status.
