H1 Out Of Status

My Spouse entering to US in L2. I lived in US for 6 years during this time I got H1B but did not work. The firm which filed my H1B said, H1B is not effective until I start working , which the I confirmed with a Lawyer.

I moved out of U.S , Now I am entering US in L2 after 2 Years

I like to know the H1B VISA which I got approved but did not work will show up as Out of Status when My spouse file the Green Card. what is the procedure to inform the USCIS to rectify this. Will this affect when I apply for EAD in L2.
