Ganeshkumar123 Posted June 18, 2012 Report Share Posted June 18, 2012 Hi, I'm currently on L1A visa working for company ABC. I'm planning to apply for a change of status next year from L1A to H1B. I'm not sure if I can legally do this since my L1A visa end date is 4 September 2013. My I94 end date is 1 January 2015. Could you please let me know if I can transfer my L1A through a different employer since my L1A visa end date is before October 1. Please note I have a valid I94 till 1 January 2015. I'm planning to apply for H1 in next year 2013. Could you please advise me on the options for my case: 1. Can I apply for Change of Status next year or 2. Should I apply for a fresh H1B next year and travel to India and get it stamped and come back. Kindly let me know the options that are available for me to apply for a H1B next year. SameerH1Bworker Posted June 18, 2012 Report Share Posted June 18, 2012 Yes, you can apply for COS. And passport visa date does not matter when you're in US, just matter is your I-94 date. You can legally stay upto date mentioned in I-94 which can be after visa stamp(on your passport) expiry date. Link to comment
