Apply New H1b/L1 in US

Hi,

I have a question regarding applying new H1B/L1 in US. Now I am holding H1B which is valid until Oct 2013 and that will be the 6th year of my H1B.

From past one year i.e., May 2011 to till date I am in INDIA which is over 365 days. Now my question is if I travel to US can I apply New H1B on 2014 Cap or new L1 in USA?

If you travel with the existing H1 visa, the time abroad would not get you a new H1.

For a new H1, you would have to stay outside the US for a year, and then enter with a new H1 which was filed under the cap.
