If yes, then, what's the process? Will the H1B visa filed will be completely new visa? Since, the quota for this year is over, will I have to wait for the next year? Attorney_22 Posted June 15, 2012 Report Share Posted June 15, 2012 Generally, unless the H3 training program is intermittent, seasonal or less than six months, an individual who has been admitted as an H3 trainee is ineligible to file a change of status/new petition to another H or L status until that individual has resided and been physically abroad for at least six months.
