H1B Transfer visa refusal

Hi,

I had an H1b approval notice I797 in 2008 from a US employer and I got Visa refusal (221(g)) because of client letter. The valid date mentioned in I797 is from 10/01/2008 to 09/27/2011.

Now I am working on L1 visa for last 3 years in California and I am trying for a new H1b from a new employer.

So could you please let me know whether I can transfer my previous H1b to a new employer so that I could be exempted from the H1b visa cap limit for the year 2013.
