H1 Quota - Petition or US Entry based?

Hi, we have a situation, any help/suggestions would be greatly appreciated.

I got a H1B petition approved on October 2006, and travelled to US on April 2007 till October 2008.

Again came on L1 on Feb 2010 and my visa is valid till December 2012.

I understand I can reprocess my H1 by new H1 petition and old quota. Now what I need to understand is how long the quota is valid. Is it until October 2012 or April 2013?

I need to find out how long do I really have to reprocess my old H1.

Thanks for the help.

Generally, an individual is eligible for 6 years of time on H1B status and is only counted against the numerical H1B cap once during the initial 6 years. Generally, time spent on L1 status does count agains the 6 years of H1B time but time spent abroad does not count against the 6 years. Individuals who have spent one full year abroad after being counted against the cap have the option of using the time remaining on their initial 6 years or being counted against the cap again. Please schedule a consultation with an experienced immigration attorney to discuss the specific facts of your case and the different options that may be available to you.
