adiatmurthy
- Had a status problem and had to go back to India while my H1B was in process. Landed in India on April 5th. USCIS was convinced with the explanation and approved my H1B on April 25th 2011 for a period of 3 years. H1B was applied by the preferred vendor of the client (where I work) - The position at the client was cancelled due to some reason. So did not have a job in US to avail the H1B at that point (May 2011) - Got a job in India and had been working in India since then (for more than a year) - Now if I want to go back to US to work, Want to know if I can resume employment with my employer if they find a client where I can work. Will the H1B be valid still (Did not avail the approved H1b petition for 1 year after it was approved) Also, I need to go to H1b Stamping if the USCIS approved H1B petition is still valid. Please help. Apologize for the lengthy query. Just wanted to explain my situation better, Link to comment
SameerH1Bworker
Yes, if H1B petition was not revoked then you can go for stamping based on your latest I-797 approval. Link to comment
