nineballs
Hi, I came to the US in April 2009 on L1B with a 3 year Visa. I went back to India after 3 years in March 2012.(During these 3 years, I went back to India on vacation twice for a month each time). Now, I came to the US in May 2012 on H4 visa and applied for a new H1 visa. I got the visa which is valid from 1st Oct 2012 to 30th Sep 2015.Now, My question is - Is my earlier stay of 3 years on L1 visa counted towards 6 year limit of H1 Visa? Will I able to extend my H1 visa beyond Sep 30th 2015 without needing an approved I140? Any help will be greatly appreciated. Thanks. Link to comment
JoeF
The time on L1 is counted towards the 6 years. Link to comment

rejikular
it would have not been accounted if there was a gap of 1 year between or your were out for a year from US but in ur case you were not so it will be counted. Link to comment
