Hi, I had H1B fm 2007 to 2010. I stayed in USA till 2009 on H1 visa. Since my project got over i returned to india. Since H1 renewal was not possible from india my company filed L1 visa and i came back to USA again in 2010 on L1B. Now i have offer from ABC company and since the current H1 quota is over for 2013 can the ABC company file for my H1 visa using the cap exemption as i was already having H1 which got expiredin Oct 2010. Appreciate your help.

Yes they can file H1 using your previous H1
