H1 B Transfer without previous H1B Petition

Hi All,

I had a applied for H1 B this year and I had a receipt number and it is in regular process. I know its gonna take couple of months to get the result.

At the same time I might get a full-time opportunity with the same client I am working now.

And my OPT expires on July 10th.

My questions is can I apply for H1 B transfer petition after my visa approval or do I need to wait till my H1-B activates(on october)?

The petition needs to get approved first, but your new employer need not wait until Oct 1 to file.
