Filing H-1b

I was in US between 2003 and 2011, I have a master’s degree (Civil Engineering) with Lamar Univ. Texas. After master’s I worked with Pillori Associates (Geotechnical Engineering Firm) as a staff engineer from 2005 to 2011.

I left US on July 17^th 2011 as i was about to finish my 6 years of H-1b.

I am out of country for one year, what is the appropriate time to apply for H-1b?

An employer can file an H1 when you have been out of the US for one year.

Since the H-1b cap for FY2013 is finished i have to wait for next april to file H-1b for FY2014??
