I didnn't get it stamped and never travelled on that. Currently I am in USA on L1b visa. I came in March oct 2008. I am looking to file H1B visa this year. One of company I talked, mentioned that i am cap exempt because i was part of cap in 2008. Could someone please validate that, really appreciate your response. Thanks in advance! Link to comment
JoeF Posted June 8, 2012 Report Share Posted June 8, 2012 If you have been counted for the quota in the last 6 years, you are not counted again. An employer can file an H1 for you at any time. Link to comment

So in your case, do you have your original petition notice from 2008 or only the receipt number? we may need the original petition. Seniors, Can anyone please confirm that we can proceed for cap exemption if we have only the receipt number? or do we need original petition notice? Link to comment
