Do I need to apply in the H-1b cap quota again..... Need help

I got the H-1b in 2008 and it was valid from October 2008 to September 2011. I worked from October 2008 to July 2009 on my H-1b and then I transfer to H-4. Now I am looking for the job again, my question is:

1. Can I start work immediately. or
   
2. Do I need to apply in the H-1b cap quota again.
   

Please suggest me about this. Thank you.

You are not subject to the cap.

A new employer can file an H1 for you at any time, and you can start working for the employer as soon as the H1 is approved.

=> Once you are counted towards H1b quota, you will be cap expected for next 6 years of your H1b stay. So, you can start immediately, you are cap exempted.

You can start work immediately with the employer (who is sponsoring your H1) once its approved.It would be cap-exempted.
