nty Posted June 7, 2012 Report Share Posted June 7, 2012 My employer received the I797C notice of approval for H1b today. It does not have any I94 attached to it. Is this I797C for my employers record and i will receive a seperate I797A with i94 ? Thank You. Link to comment
SameerH1Bworker Posted June 7, 2012 Report Share Posted June 7, 2012 Nope: if I-797 does not have any attached I-94 then you need to leave US immediately & get H1B stamping and then you can come back. Talk to your attorney immediately as you might have started accruing out of status days. Link to comment

It does not have any I94 attached to it" => I797C is the receipt of approval; NOT THE ACTUAL APPROVAL. This is just for employer and attorney's record purposes and not even supposed to give to the beneficiary. Within 1-2 weeks they will get the actual approval notice. Link to comment

If that is the case then I 94 wont be attached to your Receipt .... It is only attached to the Approval of your H1-B I797 A. Link to comment

It is only attached to the Approval of your H1-B I797 A." => I797C is issued as the receipt of approval not for acceptance of the petition, and it doesn’t attach I94. In case of denial they issue denial letter, no I797. Link to comment
