I797 Query

My employer received the I797C notice of approval for H1b today. It does not have any I94 attached to it.

Is this I797C for my employers record and i will receive a seperate I797A with i94 ?

Nope: if I-797 does not have any attached I-94 then you need to leave US immediately & get H1B stamping and then you can come back.

Talk to your attorney immediately as you might have started accruing out of status days.

It is not approval, just receipt. Did you read the ntoice? Does it say approved?

=> I797C is the receipt of approval; NOT THE ACTUAL APPROVAL. This is just for employer and attorney's record purposes and not even supposed to give to the beneficiary. Within 1-2 weeks they will get the actual approval notice.

=> It’s I797C, just receipt (of H1b approval) for attorney/ employer. It never has I94 attached.

DO you mean you got an I797 C receipt of acceptance from USCIS that they recevied the documents for H1-B petition filed.

If that is the case then I 94 wont be attached to your Receipt .... It is only attached to the Approval of your H1-B I797 A.

=> I797C is issued as the receipt of approval not for acceptance of the petition, and it doesn’t attach I94. In case of denial they issue denial letter, no I797.

Thanks for all the responses and clearing the doubt. So the I797C that my employer received was just a approval notice. Today he received the I797A which has the I94 attached to it.
