New321
Hi, I am currently on my STEM extension OPT which will expire in Dec. 2012. A for-profit employer wants to hire me, but they will most probably not be able to sponsor my Hi1b for this year (as the quota is almost over). Since they have an India office, do I have the option off getting hired and working for them in the US till my OPt expires in Dec. Then working from India after December and have them file an Hi1b for me next year for an Oct 1 2013 start date? Link to comment
SameerH1Bworker
Nope, to get US salary, one needs to be in US with valid visa status. Otherwise it will be considered as fraud & may impact future H1B/GC. Link to comment
