xoomvisitor Posted June 6, 2012 Report Share Posted June 6, 2012 My current H1 expires 9/30/2012 and i got H1B extension approved from 10/1/2012 to 9/30/2015. My visa is already expired and i have to go to india in Aug 2012 and return in the same month and I have to get visa stamp during my visit. Which I-797 should i use for visa the one expires 9/30/2012 or the other which expires 9/30/2015 (valid from 10/1/2012). If i use the second one, can I enter US before Oct 1st? Link to comment

xoomvisitor Posted June 7, 2012 Author Report Share Posted June 7, 2012 If i attend for visa on Aug 15th and show both i-797's will i get visa from Aug 15,2012 to Sep 30 2015 (which will be more than 3 yrs)? Link to comment

I found the answer http://www.state.gov...ation/87226.pdf read page 19, validity of H visas, C" From above: When there is no change of employers, and no gap in authorized status, an alien may obtain an H-1B visa that is valid during the time remaining on the first petition (and/or any extensions) and the validity of the second petition, and does not have to wait until 10 days before the start date of the second petition to reenter the United States.
