Remember you intent of F1. If the employer wants to file your H1b, it doesn't mean that you are obliged to fulfill their wish, you can deny them. Link to comment

Attorney_22 Posted June 6, 2012 Report Share Posted June 6, 2012 The H1B category is limited to those in “specialty occupations” who possess at least a Bachelor’s degree related to the field. Further, the Beneficiary of an H1B petition must possess the related degree prior to filing the H1B petition. If you already possess a Bachelor’s degree or equivalent, then a prospective employer may file an H1B petition on your behalf while you are pursuing additional studies in F1 status. If you have additional questions it is advisable to speak directly with a qualified U.S. immigration attorney. Link to comment
