CodeVISA Posted June 1, 2012 Report Share Posted June 1, 2012 Hello All, I attended VISA interview in Ottawa in Jan 2012 and got 221G. Currently my case is at USCIS for review. Iam in EVC model. Now, I got a new client in EC model. My employer is filing an amendment to the petition which is under review. Is it possible to do that? Any toughts? Any info will be appreciated... Link to comment

JoeF Posted June 6, 2012 Report Share Posted June 6, 2012 Is this the same employer? Visa and H1 petition are two different things. The employer would have to amend the LCA and H1. Then you can apply again for a visa with the modified H1 petition. Link to comment

But the thing is when I went to VISA interview in Jan 2012, VO took my I-797 and all docs.I dont have my petition with me. Still my employer can amend on the same I-797 or he will file new petition?
