My situation---PD Nov 2003,EB-3.Worked for co.A(GC sponsored) for the past 10 years.Quit for co. B 1 month back to do EB3-EB2.I am still on H1-B and want to continue on H1-B.Co.B has agreed with that. But getting the end client letter is taking a long time.It is already 1 month without the paystub since the new H1-B has not yey been filed due to the client letter.Have a valid EAD.

Q1.Is it going to be an issue later for the I-485 processing?

Q2.Does USCIS really scrutiny that much ?

I was not on bench at all but due to client letter H1-B has not yet been filed.

I am really worried, please advice and recommend.

Thanks in advance.

Joef ,Thank You so much.

Probably I have to use EAD.I was worried incase anything happens with the I-485.But i am already late to file H1-B.

Thank You

This "if something happens to the I-485" is just some overblown stuff.

If there is nothing fishy with the I-485, there is no reason to fear a denial.

And if there is something fishy, keeping an H1 wouldn't help, since then it would likely get revoked as well.
