I am planning a trip to home country, is it safe for me to travel with AP when case is not fully approved? Please share your experience & expertise. Link to comment
Attorney_17 Posted June 26, 2011 Report Share Posted June 26, 2011 It is taking about 3 months for the USCIS to process Advance Parole (AP) documents. You should not travel abroad until the AP has been approved. Also, if eligible, you should continue to maintain H-1B or L-1 status until the I-485 gets approved and only use EAD/AP as a backup. This is because if the I-485 gets denied while you are outside the U.S., then you could still enter the U.S. on H-1B or L-1 visa. Link to comment
