Is it legal getting paid US salary after H1B expires

My H1B is expiring and I will be leaving the US to comply with INS regulations. I have an option of WFH from my native country while my labor is getting processed and a new H1 applied.

1. Is it legal being on US payroll with H1 having expired?

2. Will the new H1 be an extension or a fresh H1?
