pankaj571 Posted May 31, 2012 Report Share Posted May 31, 2012 Hi I joined the new company in march; they filed for my H1B on April 10, 2012. Now, they don't want to continue with me. I'm on OPT and my OPT is going to expire on july 4th 2012. I already have offer from another company so can you please let me know what I need to do in regard to my H1-B. Do I need to ask new company to file fresh petition or I can transfer the pending petition to new company. Link to comment

Then they have to withdraw the H1 petition showing the reason. Once it is done, you can change the employer and ask them to file H1B... make sure, complete the process ASAP as your OPT is going to expire with in a month. Link to comment
wiweq Posted June 1, 2012 Report Share Posted June 1, 2012 Was the H1b approved? If yes, no need of fresh visa, use the old receipt no. If no, go for fresh visa. H1b employer knows this better, if they don’t know refer them an attorney. Link to comment
