I planned for my oversees travel in JUN. Will my deniel be an issue for my Travel in JUN? Is it possiblt to Reopen my H1B denial case in premium process? or Is it possible for my employer to apply for a new H1B? Any help is appreciated. Link to comment

catchgul Posted May 30, 2012 Report Share Posted May 30, 2012 If you are returning before the end of the current H1...you are ok..there shouldnt be a problem, since they denied the extension but your current H1 is still valid. Yes, your employer can file for a new H1 but if nothing has changed in your situation then it might not change the result either. it would most likely be denied again. Link to comment
praveena Posted June 8, 2012 Author Report Share Posted June 8, 2012 I got RFE before denial asking for this year paystubs,w2,Educational certificates, experience letters. My company lawyer did not submitted the educational certificates which caused for my denial. My employer applied for re appeal with all required documentation. I am not sure if there is a premium process for reappeal. Otherwise in general my H1B will be processed in premium. Either ways will there be any issue if I travel to India during extension? What will happen if my H1B deny again? What will happen if my H1B approves when I am in India? I have every plan to be back before JULY15th. Link to comment
