nefan Posted May 24, 2012 Report Share Posted May 24, 2012 Guys, Please help me out. I am flipping out here. I got a 221g in Feb from Ottawa,Canada. I moved to another employer when he assured me he can apply for a new h1. I was in the US for 5 years on single entry, coming in as F1. I finished 1 year on my H1 which i had obtained last year. Now, this guy tells me since I stayed in US for 5 years, I can only get H1 for the remaining of 6 years(dont know what he means by that). So he is suggesting I stay in India for 1 year and apply for fresh H1 with new 6 year eligibility. My issue is, this employer is not even like a bloody small consultancy. Its a pretty big company. Help me..Stop me from slapping this idiot..:) Link to comment

sambritish Posted May 24, 2012 Report Share Posted May 24, 2012 You were on F1-OPT for 4 years and you used only 1 year of your H1. You still have 5 more years on H1. It dioesnt matter if you change your employers, you'l have only 6 years of total on H1. Show them some link from USCIS/DoS website on details on H1. Link to comment
