L1 to H1
Hi, Is L1 to H1 conversion as Consular processing happens for all conversion cases or only for few bad luck cases? If an employer applies H1 as change of status, not as a fresh H1 application, still the consular processing approval happens. I want to know in which scenario consular processing happens exactly everytime? In which scenario it wont happens. Or it it based on luck? check the below link. http://murthyforum.atinfopop.com/4/OpenTopic?a=tpc&s=1024039761&f=4464093861&m=7351045022 Link to comment
Attorney_10
Generally, in order to be eligible to change/extend status in the U.S. the individual must be maintaining status. USCIS routinely denies request to change status when there is evidence the individual has not maintained his/her current nonimmigrant status and thus is ineligible for the change of status request. Please schedule a consultation with a qualified immgiration attorney to discuss the specific facts relating to your case. Link to comment
