L1 to H1 transfer with COS

Hi

I am currently working in USA with L1 for Employer A. Found Employer B to sponsor my H1B and he has filled the H1b pe for 2013 with COS . Now i am in a condition that i cannot leave the Emploer A until Feb 2013.

I am currently working in USA with L1 for Employer A. Found Employer B to sponsor my H1B and he has filled the H1b petition for the year 2013 with COS so that I can start working from October1st 2013 . Now I am in a condition that I cannot leave the Employer A until Feb 2013. Is it possible to amend the H1 petition from Cos to Consular processing? Will this cause any issue in the H1 petition approval?.

If you have a valid L1 visa you can travel outside USA and reenter USA .That way your COS will get cancelled.

Your H1B approval will not be effected by this.

But when you decide to start employment on H1b you will need to go to your home country and get H1 stampped.
